Patent Mining

Patent mining is a part of patent portfolio management and patent monetization service. It helps in extracting the GEM patents of a patent portfolio set. These GEM patents are the most potential patents, in terms of revenue generation and are apt for technology transfer or licensing projects.

We perform a tool based automated analysis in combination with manual patent analysis, to identify these GEM patents. In a quick tool based analysis, various parameters such as Number of Forward Citations, Total Number of unique IPC Classes of forward citations, Age of Patent, Number of Family Members, Time from Filing to Grant (Prosecution Time), Number of Independent Claims, Claim Length, etc. are considered to rank the patents.

Further, after the above step is performed, based on the understanding of the patent and its claims, each of the patent is manually analyzed and are rated to mark if the patent is infringing of not.

Once we have performed both the steps of Patent Mining, we have a list of shortlisted potential patents along with the corresponding infringing companies/products.

Patent Ranking

Patent Ranking helps our clients to understand the strong as well as weak patents of their patent portfolio. It sorts the patents according to their potential value, and makes the next steps such as Licensing, Strategy Management, etc. much easier for the clients.

Patent Ranking is a kind of evaluation of patent, and under this head, different set of rating is provided to each of the patents based on the manual analysis performed by the experts.

Infringement Feasibility

Infringement feasibility involves steps for analyzing a target patent to identify any infringing products. This includes a preparation of a brief overview report or a short claim chart, to show if any there is any overlap between the target patent and any product in the market.

The market and business relevance is kept in mind, while performing the infringement study for a target patent. Further, all the relevant details are shared with the client to understand the patent scope and market relevance.

EoU Charts

EoU charting is one of the core competency of Highbrow IP. We have vast experience in preparing Rule 11 charts. We prepare charts to show overlap between the target claim and an infringing product.

Based on the client’s requirements, we provide different types of EoU charts:

·  2-Pager EoU: This gives an overview of the product and its feature which infringes the target claim of the patent.

·  Draft EoU: This report includes clause-wise mapping of the target claim with the target product.

·  High Definition EoU: This shows a high level analysis and element-wise mapping for the target claim. This report includes exhaustive evidences, to get a stronger infringement report and is the most valuable report.

The EoU charting helps a client to analyze the potential of the patents based on the proofs located by the experts.

We provide a support for black-box testing and reverse engineering at our end, to create strong claim charts. The reverse engineering includes product testing, source-code review, packet testing, and others.
